The fourth episode of my masterclass on domain name disputes talks about financial issues under the Uniform Domain Name Dispute Resolution Policy (UDRP) and answers the question, “How much does the UDRP cost?” You can watch the video below or on the GigaLaw YouTube channel.
As I explain in the video, a UDRP complaint includes two costs: the filing fee and the legal fee.
The filing fee is paid to the UDRP service provider when the complaint is filed. It can vary based on a number of factors, including where the complaint is filed, how many domain names are in the complaint, and how many panelists are selected.
As for the legal fee, while some attorneys charge an hourly rate, I almost always charge a flat fee, agreed-upon in advance, for evaluating a domain name dispute plus researching, drafting and filing a UDRP complaint. The legal fee may vary from case to case, and that’s simply because some cases are straightforward and won’t require as much as more complicated cases. But in my practice, the trademark owner knows at the outset how much the legal fee will be, so it can decide whether to move forward with a UDRP complaint.
As I’ve said in other videos in this series, going to court can be quite expensive, but UDRP fees can be kept under control and are usually very reasonable.
