International Trademark Association (INTA) Publishes Article by Doug Isenberg About Uniform Rapid Suspension System (URS)

The International Trademark Association (INTA) published an article by Doug Isenberg of The GigaLaw Firm, "URS vs. UDRP: The Heavyweight Is Winning," in the August 1, 2016, edition of the INTA Bulletin. The article says: "ICANN’s newest domain name dispute policy, the Uniform Rapid Suspension System (URS), is proving to be an unpopular enforcement tool for trademark owners, despite the growth of registrations in the new generic top-level domains (gTLDs) to which it applies. Instead, trademark owners are relying on the proven Uniform Domain Name Dispute Resolution Policy (UDRP). The reasons are likely attributable to a number of factors, including lack of familiarity, a high burden of proof, and a limited remedy."

INTA is a global association of trademark owners and professionals. Its members are more than 6,700 organizations from 190 countries, representing some 30,000 trademark professionals and include brand owners from major corporations as well as small- and medium-sized enterprises, law firms and nonprofits. There are also government agency members as well as individual professor and student members.

Doug Isenberg Quoted in 'Trademarks & Brands Online'

Doug Isenberg of The GigaLaw Firm was quoted in an article titled "Protection: doing more with less" in Trademarks & Brands Online. The article, which discusses the importance that trademark owners should place on protecting their brands on the Internet, says:

Douglas Isenberg of GigaLaw Firm emphasises the importance of protection and the vital need for funds to support it, especially since online activity has made infringement easier and more prevalent.

According to Isenberg, “A brand can be a company’s most valuable asset, so obtaining and protecting trademarks has never been more important. The internet has made the world a much smaller place, enabling companies to sell products or services in countries that were not long ago accessible only to the biggest or best-funded players. As a result, it’s essential to be proactive about obtaining trademark rights in more jurisdictions around the globe and then identifying and enforcing those rights.

“The internet creates both opportunities and challenges. For example, the ease with which anyone can register a domain name that contains someone else’s trademark—also referred to as cybersquatting—makes it more likely that a trademark owner will encounter legal problems, but domain name dispute policies also make it easier to resolve them. In all instances, having adequate trademark rights is essential.”

Trademarks & Brands Online provides analysis on the most pressing issues affecting businesses on the Internet, from the new generic top-level domain program to online counterfeiting.
